WEBSITE TERMS OF USE

These Website Terms of Use (the “Terms”) set out the legal terms and conditions that apply between you (“you”,

“your”) and The Briderie Ltd (“us”, “we”, “our”) in respect of your use of our website at TheBriderie.com (the

“Site”), including any requests to receive our first fitting appointment (the "Service"). By accessing or using our Site

(whether to browse or to place an order to receive the Service from us), you agree to be bound by and comply with

these Terms. If you do not agree to these Terms, you must not access or use our Site and should not request to

receive the Service.

1. Who we are.

The Briderie Ltd is a company registered in England and Wales under 15448042 with registered offices at 35 Church

Road, Tunbridge Wells, Kent, TN1 1JT. You can get in touch with us via hello@thebriderie.com at any time – we

2. Accessing our Site.

2.1. The Briderie makes its Site available to you free of charge on an “as is” and “as available” basis, and makes no

representation, warranty or guarantee that the operation of the Site, or access to its content, will be

uninterrupted or error-free.

2.2. The Site is intended for use by customers living in the United Kingdom and for domestic and private use only.

We do not represent, warrant or guarantee that the Site, its content, or any Service available for purchase from

the Site are appropriate for use or available outside of the United Kingdom.

2.3. By accessing our Site you agree not to use the Site for any commercial or business purpose, and we will have no

liability to you for any direct or indirect loss of profit, loss of business, loss of revenue, loss of anticipated

savings, business interruption or loss of business opportunity.

2.4. We reserve the right to: (i) suspend, withdraw, discontinue or otherwise restrict the availability the Site at any

time for any reason (including but not limited to operational, regulatory or legal reasons); and (ii) to make

updates and changes to the Site and/or its content from time to time.

2.5. We recommend that you print a copy of these Terms for future reference.

3. Information provided via our Site.

3.1. We provide the content on the Site in good faith and for information only. While we make reasonable efforts to

ensure that the details concerning our bridal goods (the "Goods") are correct when entered into the Site, we

make no representation, warranty or guarantee that such details or any content on the Site are accurate,

complete or up to date or that the Site or its content does not infringe the rights of any third party.

3.2. Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions

that may relate to the descriptions, pricing, promotions, offers, product shipping charges, transit times and

availability in respect of the Goods. We reserve the right to correct any errors, inaccuracies or omissions, and to

change or update information or cancel orders if any information on the Site is inaccurate at any time without

prior notice (including after you have submitted your order).

3.3. No specified update or refresh date applied to the Site should be taken to indicate that all information made

available via the Site has been modified or updated.

3.4. Where our Site contains links to websites operated by third parties, these are provided for information only and

their presence does not constitute any endorsement, sponsorship or recommendation by us of them or any

information you may obtain from them. If you click on these links, you will leave our Site and we have no

control over the content of the websites at these links or these resources. Complaints, claims, concerns, or

questions regarding third-party products should be directed to the third-party.

4. Intellectual Property.

4.1. We are the owner or the licensee of all intellectual property rights in our Site, and in the material published on

it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

4.2. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any

way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately

from any accompanying text.

4.3. Our status (and that of any identified contributors) as the authors of content on our Site must always be

acknowledged.

4.4. You must not use any part of the content on our Site for commercial purposes without obtaining a licence to

do so from us or our licensors.

4.5. If you print off, copy, download, share or repost any part of our Site in breach of these Terms your right to use

our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you

have made (except that you are permitted to print off a copy of these Terms).

5. Prohibited use of our Site.

5.1. You may only use our Site for lawful purposes in accordance with these Terms.

5.2. You are prohibited from using our Site: (i) for any unlawful, fraudulent or malicious purposes or in any way that

breaches applicable law; (ii) to transmit, or procure the sending of, any unsolicited or unauthorised advertising

or promotional material or any other form of similar solicitation (spam); (iii) to infringe upon or violate The

Briderie's intellectual property rights or the intellectual property rights of others; or (iv) to upload or transmit

viruses or any other type of malicious code that will or may be used in any way that will affect the functionality

or operation of the Site or of any related website, other websites, or the Internet.

5.3. You also agree not to without our written authority access, interfere with, gather or extract data or information

from, or damage or disrupt:

5.3.1. any part of the Website;

5.3.2. any equipment or network on which the Site is stored or transmitted; or

5.3.3. any software used in the provision of the Site.

5.4. For the avoidance of doubt, this clause prohibits Site users from conducting, facilitating, authorising or

permitting any text or data mining or web scraping in relation to our Site or any Service provided via, or in

relation to, our Site for any purpose, including the development, training, fine-tuning or validation of AI

systems or models.

5.5. You shall not use, and we do not consent to the use of, our Site, or any data published by, or contained in, or

accessible via, our Site or any Services provided via, or in relation to, our Site for the purposes of developing,

training, fine-tuning or validating any AI system or model.

5.6. This clause will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data

mining or web scraping activity by contract under the laws which are applicable to us.

5.7. The provisions in this clause should be treated as an express reservation of our rights in this regard, including

for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

6. Purchases made via our Site.

Services.

6.1. We make our Service available for purchase via our Site. As a small business, we rely on our Customers

honouring their appointments and consequently we charge a non-refundable fee which will be taken upon

booking.

6.2. All orders in respect of the Service placed by you via the Site are subject to acceptance by us. We reserve the

right to refuse the provision of the Service to anyone for any reason at any time. If we are unable to accept your

request for the Service, we will inform you of the same, and will refund the booking fee (where paid).

6.3. If at any time you feel that there is something wrong with the Service, please contact our Customer Service

Team at hello@thebriderie.com as soon as possible.

Goods.

6.4. Please note that, at this time, we do not make Goods available for purchase via our Site. Goods are available to

purchase from our store and subject to consultation with us. The description of any Goods on our Site, or

provided in any catalogues, brochures, or other forms of advertisement made available by us does not

constitute a contractual offer to sell the Goods.

6.5. We take all reasonable care to ensure that descriptions, images and prices in relation to the Goods are correct

and displayed as accurately as possible, however, Goods may vary slightly from their pictures, and prices shown

via our Site are indicative only and may vary. The images and packaging of the Goods on our website are for

illustrative purposes only.

6.6. The price of the Goods and any additional delivery or other charges for the Goods are set out at the date we

accept the Order or such other method as agreed between us in writing.

6.7. A Contract for the purchase of any Goods will be made in accordance with and subject to our Terms and

Conditions of Sale (available here) and we recommend that you read these carefully before considering making

any purchase with us.

7. Liability.

7.1. In respect of our provision of the Site and/or the Service:

7.1.1. we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes

liability for death or personal injury caused by our negligence or the negligence of our employees, agents or

subcontractors and for fraud or fraudulent misrepresentation;

7.1.2. we only provide our Site and Service for domestic and private use. You agree not to use our Site and/ or

Service for any commercial or business purposes, and we have no liability to you for any loss of profit, loss

of business, business interruption, or loss of business opportunity;

7.1.3. we exclude all implied representations, warranties, conditions and terms (whether implied by statute,

common law or otherwise), which may apply in respect of the Site or its content, and/or the Service to the

fullest extent permitted by law.

7.2. Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any

Goods to you, which will be set out in our Terms and Conditions of Sale. Nothing in these Terms affects your

legal rights as a consumer (including your rights to cancel online purchases).

8. Privacy.

8.1. The Briderie respects your personal data and will only use personal data that you provide about yourself for

the purpose of fulfilling your Order in accordance with The Briderie's Privacy Policy. By submitting your

personal data to us you consent to The Briderie using your personal data as described.

9. General Terms.

9.1. Applicable Law. These Terms will be subject to and interpreted in accordance with the laws of England and

Wales.

9.2. Disputes. We will always try to avoid disputes and complaints and endeavour to resolve any disputes amicably.

Please contact us directly to discuss any complaints and we will respond within 48 hours. If you are not satisfied

and a resolution is not achievable to each party's satisfaction, then disputes can be submitted to the jurisdiction

of Courts in England and Wales, or where the Customer lives in Scotland or Northern Ireland, in the courts

respectively Scotland or Northern Ireland.

9.3. Severability. Each of the sections of these Terms operates separately. If any court or relevant authority decides

that any of them are unlawful, the remaining sections will remain in full force and effect.

9.4. Third Parties. These Terms are only between you and us, and nobody else has any rights to enforce these

Terms. This does not affect your statutory rights.

9.5. Waiver. A failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver

of such right or provision, or any other right or provision.

9.6. Changes to our Terms. We will make the most current version of the Terms available on this page and reserve

the right to update these Terms from time to time. Your continued use of or access to our Site following the

publishing of updated Terms to our Site constitutes acceptance of those updated Terms.

9.7. Entire Agreement. These Terms (along with any documents incorporated herein by reference) constitute the

entire agreement and understanding between you and us and govern your use of the Site, superseding any prior

or contemporaneous agreements, communications and proposals, whether oral or written, between you and us.
